Selling Property in Victoria

The Sale


When selling property, some things to think about are the:

  • Chattels - What items in your house will stay and which will you take with you?
  • Lease or Vacant Possession - Will the property be sold with or without a tenant?
  • Building Approvals & Renovations - Was the property built or have any renovations been carried out in the last seven years? If so, we can make sure your contract includes all of the necessary documents and disclosures.
  • Auction Sale  - If you sell your property via an auction sale, there will be no three-day cooling off period for the purchaser and the contract will usually not be subject to any other conditions. This means that once the purchaser signs the contract, it is binding and unconditional.
  • Private Sale - If you sell your property via a private sale, all Victorian contracts must include a three-day cooling off period. The purchaser can also request the contract be subject to other things, such as pest & building or a finance clause, but it is up to you if you want to allow this or not.

The Deposit


When Selling Property in Victoria, the Section 27 scheme is designed to enable vendors to access the deposit money earlier than settlement to help with things like moving costs and purchasing another home. The deposit can be released immediately if the purchaser signs the Section 27 form, but if not, 28 days need to pass before the deposit can be released.

We can facilitate this scheme for you if you request it and we will flag the task as a priority so that the deposit gets released to you as soon as possible. This can assist you greatly in the purchase of your next property by allowing you to pay for the deposit of that property.

The Contract


Not All Contracts are Created Equal

Not all contracts created in Victoria contain all of the certificates that we always include in our contracts. Some agencies will only include a copy of the water bill or council rates notice, which could potentially leave important information out of your Vendors Statement (Section 32). All of our contracts include a Land Information Certificate (LIC), Water Information Certificate (WIS), Planning Certificate, and Land Tax Certificate. This protects you during and after your sale by providing full property disclosure.
